definition
Separation of powers was added to the constitution so that one branch or head of the government does not receive or posses to much power.
the three branches
-The Legislative branch concludes of the
House of Representatives and the US Senators.Legislative branch also consists of the 435 members of the house of representatives and the 100 people in the senate.
-The executive branch is ran by the US president and vice president. There are 15 cabinets which are also apart of the executive branch hand chosen by the president and are confirmed by the US Senate.
-The Judicial Branch is ran by the supreme court with chief of justice and all associates under him.
powers of the branches
-legislative: most important: create laws, other: collect taxes, declare war, fund military
-executive: president: leader, commander in chief, appoint judges, veto legislative branch
-judicial: biggest power: judicial review: decide if laws are unconstitutional
how does it limit government power
-Our principle supports the
idea of limited government because these three branches practice checks and balances
-Checks and balances is the process is what separates the powers of the government: one branch is not more powerful than the other
-the president can veto the legislative branch, congress can make a majority vote against the president, and the judicial branch can veto an unconstitutional law
why separation of powers is important
-the
separation of powers is important because it prevents each branch of government from abusing their power.
-French political philosopher Baron de Montesquieu coined the phrase "separation of powers" in his 1748 treatise The Spirit of the Laws. He supported the idea of creating a government that was divided into different bodies led by different individuals. He believed this would prevent government from threatening the freedom of the people and the threat of despotism (absolute power in a
cruel way)
2 examples
1. the partial birth abortion bill was vetoed with the knowledge that a 2/3 majority was unlikely to override the president's decision; the bill would've made it illegal for women to have an abortion in a specific later-term date where the mother's life would have been endangered
2. Alvaraz was elected to a Walnut Valley Water District Board of Directors and lied about his achievements
as a marine. Congress passed an act called the Stolen Valor Act of 2005 and signed by George Bush. Alvaraz was charged with false representation and for lying about receiving a military medal. Supreme Court ruled the Valor Act unconstitutional because infringed the first amendment.
